Beauhème is a third-party exchange marketplace that connects beauticians or service providers in the mobile beauty environment with retail customers. We do not assume liability for beauticians and/or clients and solely act as a connecting online marketplace.
Beauhème allows all users to use the SagePay payment platform to buy or accept payments for services on Beauhème.
Service Provider (Beautician) Fees
We charge a price per service fee. The minimum transaction value is R100. When you use Beauhème, you will be charged a percentage (%) fee depending on the service offering as some percentage (%) fees may vary from service to service. The service fee will be specified when selecting the type of service offering on the Beauhème platform. These are the only fees you will be charged for using Beauhème. For example, if you list a beauty service for R100, and the service percentage (%) fee is 10% of the advertised price, then the Beauhème fee that will be deducted is R10.00.
Client (Beauty) Fees
When a client book a specific service advertised by a beautician, the client will only pay the advertised price. No other service or transaction fees are payable by the client.
When listing please include as much information as possible so users can have a clear understanding of the service you provide.
Refunds and cancellations should be on a case by case basis. Whenever a beautician lists a service and gets a booking for the advertised service, the beautician must accept the booking within a reasonable timeframe and notify the client of the booking acceptance or rejection. Once a service is booked and accepted by the beautician, the service is rendered to the client. After the service is rendered, the client has the option to rate the beautician’s services on the Beauhème platform and can confirm that the service did take place. If the client chooses not to rate the service, Beauhème will, after 24 hours automatically confirm that the service has taken place and payment to the beautician can be processed accordingly. At this stage, the client will be charged for the service rendered by the beautician unless the client submits a complaint to the Beauhème team. Clients should notify beauticians as soon as possible if they need to cancel a booking. Beauhème is responsible for refunds, but not booking cancellations. Therefore, Beauhème can offer a refund guarantee if the client feels that the service rendered by the beautician was not up to the Beauhème standard but, Beauhème cannot offer a guarantee of a refund if the booking was not cancelled within a reasonable timeframe and with the consent or acknowledgement of both parties.
Beauhème will not sell or disclose your personal information to third parties without your explicit consent. Beauhème stores and processes content on computer servers that are protected by physical as well as technological security.
Keep your password secure. You are fully responsible for all activity, liability, and damage resulting from your failure to maintain password confidentiality. You agree to immediately notify Beauhème of any unauthorized use of your password or any breach of security. You also agree that Beauhème cannot and will not be liable for any loss or damage arising from your failure to keep your password secure.
Circumvention is the process of avoiding something, such as a legal obligation. With respect to Beauhème, when a client finds a beautician on our website, they agree to keep the relationship on Beauhème. This means that during this time all payment transactions between the client and beautician must go through Beauhème; “under the table” payments aren’t allowed. Paying someone outside of the Beauhème platform is considered Circumvention—something you agree not to do when you accept the Terms of Service. If you breach this agreement, you will be removed from Beauhème.
Beauhème shall have the right at any time to change or modify the terms and conditions applicable to the User's use of www.beauheme.co.za, or any part thereof, or to impose new conditions, including, but not limited to, adding fees and charges for use. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, posting on www.beauheme.co.za or by electronic or conventional mail, or by any other means by which the User obtains notice thereof. Any use of www.beauheme.co.za by the User after such notice shall be deemed to constitute acceptance by the User of such changes, modifications or additions.
Any User registered on the Beauhème platform shall use www.beauheme.co.za for lawful purposes only. User shall not post or transmit through www.beauheme.co.za any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, or which, without Beauhème's express prior approval, contains advertising or any solicitation with respect to products or services. Any conduct by a User that in Beauhème's discretion restricts or inhibits any other User from using or enjoying www.beauheme.co.za will not be permitted. User shall not use www.beauheme.co.za to advertise or perform any commercial solicitation, including, but not limited to, the solicitation of users to become subscribers of other on-line information services competitive with Beauhème.
www.beauheme.co.za contains copyrighted material, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound, and the entire contents of www.beauheme.co.za are copyrighted as a collective work under the South African copyright laws. Beauhème owns a copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it. User may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part. User may download copyrighted material for User's personal use only. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express permission of Beauhème and the copyright owner. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. User acknowledges that it does not acquire any ownership rights by downloading copyrighted material.
User shall not upload, post or otherwise make available on www.beauheme.co.za any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right and the burden of determining that any material is not protected by copyright rests with the User. User shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. By submitting material to any public area of www.beauheme.co.za, the user automatically grants, or warrants that the owner of such material has expressly granted Beauhème the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. User also permits any other User to access, view, store or reproduce the material for that User's personal use. User hereby grants Beauhème the right to edit, copy, publish and distribute any material made available on www.beauheme.co.za by the user.
The foregoing provisions of this Section are for the benefit of Beauhème, its subsidiaries, affiliates and its third party content providers and licensors and each shall have the right to assert and enforce such provisions directly or on its own behalf.
Beauhème shall have the right, but not the obligation, to monitor the content of www.beauheme.co.za including online conversations and forums, to determine compliance with this Agreement and any operating rules established by Beauhème and to satisfy any law, regulation or authorized government request. Beauhème shall have the right in its sole discretion to edit, refuse to post or remove any material submitted to or posted on www.beauheme.co.za. Without limiting the foregoing, Beauhème shall have the right to remove any material that Beauhème in its sole discretion, finds to be in violation of the provisions hereof or otherwise objectionable.
User agrees to defend, indemnify and hold harmless Beauhème its affiliates and their respective directors, officers, employees and agents from and against all claims and expenses, including attorneys' fees, arising out of the use of Beauhème by User or User's Account.
Either Beauhème or the User may terminate this Agreement at any time. Without limiting the foregoing, Beauhème shall have the right to immediately terminate User's Account in the event of any conduct by User which Beauhème in its sole discretion, considers to be unacceptable, or in the event of any breach by User of this Agreement.
Beauhème, its logos are trademarks of Beauhème All rights reserved. All other trademarks appearing on Beauhème are the property of their respective owners.
